My aim in this essay is to show that some of the arguments usually offered by the feminist movements and conservatists against the pornography are not sound, and so, are not sufficient to hold that pornography is morally wrong.

The assumption that coercion is largely responsible for our legal systems’ efficacy is a common one. I argue that this assumption is false. But I do so indirectly, by objecting to a thesis I call “(Compliance)”, which holds that most citizens comply with most legal mandates most of the time at least partly in virtue of being motivated by legal systems’ threats of sanctions and other unwelcome consequences. The relationship between (Compliance) and the efficacy of legal systems is explained in (...) section 1. There I also show that (Compliance) must be rejected for it relies on unsubstantiated empirical assumptions. In section 2, I claim that an alternative, and more refined, formulation of (Compliance) also lacks adequate support. I conclude with a few general remarks about the centrality of coercion in our thought and talk about legal systems. (shrink)

In discussing whether legal systems are necessarily coercive, legal philosophers usually appeal to thought experiments involving angels or other morally driven beings who need no coercion to organise their social lives. Such appeals have invited criticism. Critics have not only challenged the relevance of such thought experiments to our understanding of legal systems; they have also argued that, contrary to the intuitions of most legal philosophers, the ‘man on the Clapham Omnibus’ would not hold that there is law in a (...) society of angels because the view that law is necessarily coercive ‘enjoys widespread support among laypersons’. This is obviously an empirical claim. Critics, however, never systematically polled the ‘man on the Clapham Omnibus’. We boarded that bus. This article discusses findings from five empirical studies on the relationship between law and coercion. (shrink)

Most legal and political philosophers agree that typical legal systems are coercive. But there is no extant account of what typically makes typical legal systems coercive when they are coercive. This paper presents such an account and compares it with four alternative views. Towards the end I discuss the proposed account’s payoffs. Among other things, I show how it can help us explain what I call ‘comparative judgements’ about coercive legal systems (judgements such as ‘Legal system a is more coercive (...) than legal system b’) and how it can help the development of social scientific inquiries into the coerciveness of our legal systems. The relationship between law and coercion has been, and still is, a central topic in legal philosophy. Despite this, discussion about it is immersed in confusion. Some philosophers have noticed this, but hardly any work has been done to attempt to solve or even identify the confusions. This paper aims to fill this gap. Here I propose distinctions and qualifications that help us clarify the relationship between law and coercion and avoid confusion. Up until recently, most legal philosophers have argued that an action is a token of sanctioning if, and only if, (i) its performance brings about unwelcome consequences to the targets, and (ii) it is performed as a response to the breach of a duty. In this paper I take issue with this account. I first add some qualifications to it in order to present it in its most plausible form. After doing this, I advance a series of hypothetical cases which (...) suggests that this account fails. I then propose a new account of sanctioning, whereby an action is a token of sanctioning if, and only if, it is performed in an appropriate context and is apt for punishing wrongdoers. (shrink)

The idea that legal systems conditionally threaten citizens is taken by most legal and political philosophers as ‘reasonably uncontroversial,’ ‘obvious,’ or as portraying ‘a large part of how law operates.’ This paper clarifies and ultimately rejects this idea: our legal systems, it is argued, rarely address citizens via conditional threats. If correct, the conclusion defended in this paper might force us to re-examine core debates in legal and political philosophy that rely on the assumption that legal systems often threaten citizens: (...) debates about the justification of the state, global justice, and the coerciveness of law. Whether legal systems are necessarily coercive raises normative concerns. Coercion carries a presumption of illegitimacy and a special justificatory burden. If legal systems are necessarily coercive, coerciveness necessarily taints our legal institutions. Traditionally, legal systems have been regarded as contingently coercive. This view is mainly supported by the society of angels thought experiment. For the past few years, however, this traditional view has been under attack. Critics have challenged the reliability of the thought experiment and have urged us to centre (...) the discussion on typical legal systems: legal systems made by humans to address human needs. Once we do so – they claim – we would inevitably reject the traditional view. This paper argues that the critics are wrong. After discussing key features of the society of angels thought experiment and responding to objections, it is argued that even typical legal systems are contingently coercive. Introduction to the Law and Coercion Symposium.

In the past few years, health and human rights scholars have stressed upon the need for rebuilding or reforming our health systems to make them both more resilient to health emergencies and less prone to nurturing inequalities. Discussions about health reform often centre on the ends of reform: the kind of health systems that should be built and the demands of justice that they should be able to satisfy once reformed. However, little has been said about the demands of justice (...) in or during health reforms. This chapter intends to start that discussion. Borrowing from the literature on transitional justice, we argue that an analogous problem of transitional justice exists in the context of health. We outline some of the key elements of transitional health justice, including some of its key demands, practices, and corresponding institutional framework. We conclude by highlighting an important relationship between transitional health justice and transitional justice. (shrink)

Technology scholars and journalists have recently called attention to digital platforms’ and devices’ ability to influence users based on their present moods, stress level, hunger, and other transient features. For them, such influence based on users’ present status – what the chapter calls “real-time profiling” – is not only a clear form of wrongful manipulation but also online manipulation’s future. The chapter aims to explain what makes real-time profiling wrong (when wrong) and discusses problems associated with its regulation. After explaining (...) what real-time profiling consists in and showing that it can be presumed to be a form of manipulation, the chapter argues that real-time profiling is wrong both because the profiler psychologically hijacks profiled subjects and because it works as a gateway to further wrongs. Towards the end, the chapter discusses some implications of the proposed account for the legal regulation of online manipulative technologies like real-time profiling. It is argued that existing legal frameworks are not fine-grained enough to deal with the wrongs associated with real-time profiling and related forms of online manipulation. (shrink)

In this paper we extend Heidi Hurd’s “correspondence thesis” to the termination of pregnancy debate and argue that the same reasons that determine the permissibility of abortion also determine the justifiability of acts involving conscientious objection against its performance. Essentially, when abortion is morally justified, acts that prevent or obstruct it are morally unjustified. Therefore, despite conscientious objection being legally permitted in some global south countries, we argue that such permission to conscientiously object would be morally wrong in cases of (...) morally justifiable termination of pregnancy. After presenting and defending our “correspondence argument” we suggest that conscientious objection should be denied as a matter of public health policy in developing counties, even in cases where adequate referral services are possible. Towards the end, we extend our argument to midwives, nurses, and prospective students in the field. Given their essential position in resource‐poor contexts; they too have no claim to conscientious objection. (shrink)

The demand for integrating and sharing heterogeneous data online has attracted the interest of cultural institutions in making information access and retrieval more effective via Semantic Web technologies. The present study proposes a digital repository for 3D scans of modernist sculptures in public spaces in the city of Rio de Janeiro, Brazil, with a view to ensuring access, use, reuse and preservation of this information. This is a qualitative exploratory experimental study based on the scientific literature and specific empirical material. (...) It presents the analysis results of vocabularies for physical artifact documents and their digital counterparts on the Semantic Web and a discussion on how these align with the nature of the metadata determined here, as well as a metadata modeling prototype implemented on the Tainacan platform and aimed at cataloging digital 3D replicas. We claim that the proposed model for documenting cultural heritage assets on Tainacan is easy to implement, in that it uses accessible technology with a wide internet user base, highly expressive in its descriptions of 3D and multimedia content and based on well-established metadata and ontology standards recommended by regulatory bodies and communities such as the World Wide Web Consortium and International Organization for Standardization. Pictures are created objects that have the function of generating a perceptual experience. In this sense, they are “experiential artifacts” (Terrone forthcoming). The experience elicited by pictures – usually visual (but for non-visual pictorial experience see e.g. Lopes 1997) – is a composite perceptual experience, in which the “perception” of the depicted scene (which is not in front of us) is generated by and experienced along the perception of the marked surface (the object that is actually in front of (...) us). This experience is usually called a “pictorial experience”. A philosophical analysis of such an experience amounts to answering the following questions: How should we describe the phenomenology of pictorial experience? What is it like to experience pictures? How should the “perception” of the depicted scene be characterized? Is it really a form of perception? How does it relate to the perception of the marked surface? (shrink)

Aristotle contrasts episteme and doxa through the key notions of universal and necessary. These notions have played a central role in Aristotle’s characterization of scientific knowledge in the previous chapters of APo. They are not spelled out in APo I.33, but work as a sort of reminder that packs an adequate characterization of scientific knowledge and thereby gives a highly specified context for Aristotle’s contrast between episteme and doxa. I will try to show that this context introduces a contrast in (...) terms of explanatory claims: on the one hand, episteme covers those claims which capture explanatory connections that are universal and necessary and thereby deliver scientific understanding; on the other hand, doxa covers the explanatory attempts that fail at doing so. I discuss the exact meaning of the thesis according to which the object of scientific knowledge is necessary. The thesis is expressed by Aristotle in the Posterior Analytics, in his definition of scientific knowledge. The traditional interpretation understands this definition as depending on two parallel and independent requirements, the causality requirement and the necessity requirement. Against this interpretation, I try to show, through the examination of several passages that refer to the definition of scientific knowledge, that the necessity requirement specifies (...) more exactly the causality requirement: what cannot be otherwise is the explanatory relation between the explanandum and the cause by which it is what it is. In Posterior Analytics 71b9 12, we find Aristotle’s definition of scientific knowledge. The definiens is taken to have only two informative parts: scientific knowledge must be knowledge of the cause and its object must be necessary. However, there is also a contrast between the definiendum and a sophistic way of knowing, which is marked by the expression “kata sumbebekos”. Not much attention has been paid to this contrast. In this paper, I discuss Aristotle’s definition paying due attention to this contrast (...) and to the way it interacts with the two conditions presented in the definiens. I claim that the “necessity” condition ammounts to explanatory appropriateness of the cause. (shrink)

Joint attention customarily refers to the coordinated focus of attention between two or more individuals on a common object or event, where it is mutually “open” to all attenders that they are so engaged. We identify two broad approaches to analyse joint attention, one in terms of cognitive notions like common knowledge and common awareness, and one according to which joint attention is fundamentally a primitive phenomenon of sensory experience. John Campbell’s relational theory is a prominent representative of the latter (...) approach, and the main focus of this paper. We argue that Campbell’s theory is problematic for a variety of reasons, through which runs a common thread: most of the problems that the theory is faced with arise from the relational view of perception that he endorses, and, more generally, they suggest that perceptual experience is not sufficient for an analysis of joint attention. Translation of Aristotle's Metaphysics Lambda into Portuguese.

I discuss an important feature of the notion of cause in Post. An. 1. 13, 78b13–28, which has been either neglected or misunderstood. Some have treated it as if Aristotle were introducing a false principle about explanation; others have understood the point in terms of coextensiveness of cause and effect. However, none offers a full exegesis of Aristotle's tangled argument or accounts for all of the text's peculiarities. My aim is to disentangle Aristotle's steps to show that he is arguing (...) in favour of a logical requirement for a middle term's being the appropriate cause of its explanandum. Coextensiveness between the middle term and the attribute it explains is advanced as a sine qua non condition of a middle term's being an appropriate or primary cause. This condition is not restricted either to negative causes or to middle terms in second‐figure syllogisms, but ranges over all primary causes qua primary. (shrink)

Paul Guyer is well known for defending the claim that freedom, understood as the capacity to set ends, is Kant’s fundamental value. In contrast, I have developed a reading of Kant’s ethics that places autonomy and community at the heart of Kant’s ethics. At the heart of my account is a conception of autonomy understood as what I call the capacity for sovereignty. I argue that these two positions can be made compatible. To do this involves making a distinction between (...) the concepts of dignity and value and arguing that although autonomy, understood as the capacity for sovereignty, is the source of the dignity of humanity, this is compatible with the claim that the ultimate value for Kant is freedom understood as the capacity to set ends. To explain how this is possible I appeal to Wilfrid Sellars Kantian account of the moral point of view in Science and Metaphysics. (shrink)

John Danaher and Sven Nyholm have argued that automation, especially of the sort powered by artificial intelligence, poses a threat to meaningful work by diminishing the chances for meaning-conferring workplace achievement, what they call “achievement gaps”. In this paper, I argue that Danaher and Nyholm’s achievement gap thesis suffers from an ambiguity. The weak version of the thesis holds that automation may result in the appearance of achievement gaps, whereas the strong version holds that automation may result on balance loss (...) in possibilities for workplace achievements, i.e., in the appearance of an overall gappier work landscape. Against the strong version of the achievement gap thesis, I characterize situations where automation may result in boons to meaning-conferring workplace achievements: the appearance of what I call achievement spread and achievement swaps. Nevertheless, Danaher and Nyholm are right to worry about some uses of automation whereby human workers become subservient to AI. But these situations are better framed, I argue, as autonomy gaps rather than achievement gaps. (shrink)

I discuss what Aristotle means when he say that scientific demonstration must proceed from necessary principles. I argue that, for Aristotle, scientific demonstration should not be reduced to sound deduction with necessary premises. Scientific demonstration ultimately depends on the fully appropriate explanatory factor for a given explanandum. This explanatory factor is what makes the explanandum what it is. Consequently, this factor is also unique. When Aristotle says that demonstration must proceed from necessary principles, he means that each demonstration requires the (...) principle that is the necessary one for the fully appropriate explanation of its explanandum. This picture also provides a key to understand Aristotle's thesis that scientific explanation depends on essences: it is the essence of the attribute to be explained that should be stated as the fully appropriate explanatory factor. Public participation in scientific research has gained prominence in many scientific fields, but the theory of participatory research is still limited. In this paper, we suggest that the divergence of values and goals between academic researchers and public participants in research is key to analyzing the different forms this research takes. We examine two existing characterizations of participatory research: one in terms of public participants' role in the research, the other in terms of the virtues of the research. In our (...) view, each of these captures an important feature of participatory research but is, on its own, limited in what features it takes into account. We introduce an expanded conception of norms of collaboration that extends to both academic researchers and public participants. We suggest that satisfying these norms requires consideration of the two groups' possibly divergent values and goals, and that a broad characterization of participatory research that starts from participants' values and goals can motivate both public participants’ role in the research and the virtues of the research. The resulting framework clarifies the similarities and differences among participatory projects and can help guide the responsible design of such projects. (shrink)

At some point in the Incessu Animalium, Aristotle appeals to some geometrical claims in order to explain why animal progression necessarily involves the bending (of the limbs), and this appeal to geometrical claims might be taking as violating the recommendation to avoid “kind-crossing” (as found in the Posterior Analytic). But a very unclear notion of kind-crossing has been assumed in most debates. I will argue that kind-crossing in the Posterior Analytics does not mean any employment of premises from a discipline (...) other than that to which the explanandum belongs. Kind-crossing was meant to cover a specific sort of employment of premises from a different discipline, namely, the case in which premises from a discipline X are taken as the most important explanatory factor that delivers the fullest appropriate explanation of an explanandum within discipline Y. If this is so, the employment of geometrical premises in the Incessu Animalium is not an instance of the prohibited kind-crossing, but something that is in line with the theory of the Posterior Analytics. I discuss in this paper the six requirements Aristotle advances at Posterior Analytics A-2, 71b20-33, for the premisses of a scientific demonstration. I argue that the six requirements give no support for an intepretation in terms of “axiomatization”. Quite on the contrary, the six requirements can be consistently understood in a very different picture, according to which the most basic feature of a scientific demonstration is to explain a given proposition by its appropriate cause.

Translation of Aristotle's Parts of Animals Book I into Portuguese, with full commentaries.

In Prior Analytics I.30, Aristotle seems too much optmistic about finding out the principles of sciences. For he seems to say that, if our empirical collection of facts in a given domain is exhaustive or sufficient, it will be easy for us to find out the explanatory principles in the domain. However, there is a distance between collecting facts and finding out the explanatory principles in a given domain. In this paper, I discuss how the key expression in the sentence (...) at 46a25 should be interpreted: “the true characteristics of things” (“τῶν ἀληθῶς ὑπαρχόντων τοῖς πράγμασιν”). I argue that, on a more accurate interpretation of the expression, Aristotle’s point would cease to look like a piece of naïve or even silly optimism. (shrink)

This chapter argues in favour of three interrelated points. First, I argue that demonstration (as expression of scientific knowledge) is fundamentally defined as knowledge of the appropriate cause for a given explanandum: to have scientific knowledge of the explanandum is to explain it through its fully appropriate cause. Secondly, I stress that Aristotle’s notion of cause has a “triadic” structure, which fundamentally depends on the predicative formulation (or “regimentation”) of the explanandum. Thirdly, I argue that what has motivated Aristotle to (...) choose the syllogism as a demonstrative tool was precisely the fact that syllogisms are apt to express causal relations in their triadic structure. Instead of complaining against Aristotle’s preference for the syllogisms as demonstrative tools, I argue that Aristotle was fully aware of the advantages of regimenting the explanandum into a predication. One of these advantages is to abandon a purely extensional standpoint and to highlight the importance of the notion of relevancy in explanation. (shrink)

I have two aims in this paper. First, I argue that, in Aristotle’s theory of the four causes, there is a basic and common feature by which all causes are causes: they all work in a triadic framework in which they explain why a given attribute holds of a given underlying thing. Secondly, I argue against a version of “compatibilism” according to which each kind of cause is complete in its own domain and does not compete with any other kind. (...) I discuss Aristotle's treatment of essence and definition in Metaphysics VII.4. I argue that it is coherent and perfectly in accord with its broader context. His discussion in VII.4 offers, on the one hand, minimal criteria for what counts as definition and essence for whatever kind of object, but also, on the other hand, stronger criteria for a primary sort of definition and essence—and thereby it serves the interest of book VII in pointing to the explanatory power of the essence (...) of composite substances. Corporate social responsibility (CSR) aspirations by companies have been identified as a motivating factor for active employee participation in CSR implementation. However, a failure to practise what one preaches can backfire and lead to attribution of hypocrisy. Drawing on a qualitative study of an award-winning sustainability pioneer in the cosmetics sector, we explore the role of moral judgement in how and when employees interpret word–deed misalignment in CSR implementation as hypocritical. First, our case reveals that high CSR aspirations by companies (...) raise employees’ moral expectations. Second, we develop a framework that explains variations in employees’ hypocrisy interpretations based on consequentialist and deontological forms of moral judgement. Our research advances a contextual view of hypocrisy, not as an objective characteristic of an organisation, but as an outcome of interpretative processes of perceived motives and results in CSR implementation. Our framework thereby explains why even highly committed organisations may face accusations of hypocrisy. (shrink)

Bietti, Tilston and Bangerter take an evolutionary approach towards memory transmission and storytelling, arguing that storytelling plays a central role in the creation and transmission of cultural information. They suggest that storytelling is a vehicle to transmit survival‐related information that helps to avoid the costs involved in the first‐hand acquisition of that information and contributes to the maintenance of social bonds and group‐level cooperation. Furthermore, Bietti et al. argue that, going beyond storytelling’s individualist role of manipulating the audience to enhance (...) fitness of the narrator, that these adaptive functions of storytelling may well be assigned to other forms of language use besides narration (e.g., instructional discourse and argumentation). Based on this evidence, Bietti and colleagues claim that the specific adaptive function of storytelling lies in making sense of non‐routine, uncertain, or novel situations, thereby enabling collective sensemaking. This paper explores the intersection of René Girard's mimetic theory and the algorithmic society, particularly in the context of the potential advent of Artificial General Intelligence (AGI). Girard's theory, which elucidates the dynamics of desire, rivalry, scapegoating, and the sacrificial crisis, provides a unique lens through which to examine the complexities of our relationship with AI and its role in the creation of the sacred. As individuals increasingly rely on AI recommendations, the distinction between personal choice and algorithmic manipulation becomes (...) less clear, raising concerns about the authenticity of cultural expressions and the role of algorithms in shaping cultural narratives. The triangular structure of desire, with AI as the model and individuals as the imitators, underscores the power of algorithms in this process. The sacrificial crisis, a key concept in Girard's theory, becomes a critical point of reflection in the algorithmic society. The exposure of the scapegoating mechanism reveals the destructive potential of algorithmic manipulation and calls for new forms of understanding, empathy, and non-violent solutions. This paper argues that recognizing the sacrificial crisis can prompt individuals and society to critically examine the impact of AI's influence, challenge the narratives it perpetuates, and reclaim agency in the face of algorithmic dominance. This paper further discusses the potential implications of the emergence of AGI, which could intensify the influence of algorithms on the creation of the sacred due to its advanced cognitive capabilities and deep understanding of human desires and behaviors. This could fuel a rapid evolution of the mimetic ecosystem, with profound implications for personal freedom, independent decision-making, and the formation and preservation of individual identity. This paper concludes by emphasizing the need for responsible algorithmic practices and ethical considerations to ensure that the creation of the sacred serves the common good in the algorithmic society. This paper discusses the following question: why was the term “dunatos” (“possible”) employed by Aristotle as an alternative label for imperfect syllogisms in his discussion of assertoric syllogistic? My answer ascribes to Aristotle a bottom up perspective, in which he stresses what is necessary in the premise-pairs to attain target conclusions of a given form within a given figure. I argue that “dunatos” is employed by Aristotle to stress that an imperfect syllogism is always one of the possible options to (...) attain a conclusion of a given form within a given figure. I also argue that this picture sheds some light on Aristotle’s clarifications of the final clause in his definition of syllogism. (shrink)
